OpteLux Inc. (“OpteLux,” “we,” “us,” or “our”) and affiliated eye‑care practices for which we provide administrative support (“Affiliates”) operate the websites and mobile applications that link to this Privacy Policy (collectively, the “Services”). This Policy explains how we collect, use, disclose, and safeguard the personal information you provide—or that is provided on your behalf—when you interact with the Services. Independent eye‑care practices that run their own sites or apps maintain their own privacy notices; please review those notices separately.

We may revise this Policy from time to time. When we make material changes, we will update the “Effective Date” above. All amendments take effect once posted unless a later date is specified.

Some of the above items—such as health data, precise geolocation, and children’s information—may qualify as “sensitive” under certain privacy laws. 

4  How We Use Personal Information 

  • Provide and deliver products and Services, including virtual try‑on, Home Try‑On, and order fulfilment. 
  • Create, maintain, and service accounts. 
  • Process payments, insurance claims, refunds, and other transactions. 
  • Operate, analyse, and improve the Services and our business. 
  • Send service messages, respond to enquiries, and offer customer support. 
  • Conduct marketing, advertising, and promotions (you may opt out at any time). 
  • Detect, investigate, and help prevent fraud, security incidents, and misuse. 
  • Comply with legal obligations and exercise or defend legal claims. 
  • Perform corporate analytics, audits, and potential business transfers. 

 
Virtual try‑on scans and facial‑measurement data are processed only on your device and are not stored or transmitted once the feature is closed. 

5  When We Disclose Personal Information 

  • Affiliates and service providers that perform functions on our behalf (e.g., payment processors, shipping companies, IT hosts, marketing vendors). 
  • Eye‑care professionals involved in verifying or fulfilling your prescription. 
  • Advertising and analytics partners that help us deliver relevant content; certain state laws may treat this as a “sale” or “share.” 
  • Law‑enforcement or regulatory authorities when required to protect rights or comply with the law. 
  • Parties to a corporate transaction if we reorganise or transfer parts of our business. 

 
We do not exchange your data for cash consideration. However, some U.S. state privacy laws may classify certain advertising‑technology disclosures as a “sale” or “sharing” of personal information; see Section 8 for your opt‑out rights. 

6  Cookies & Similar Technologies 

We and our partners use cookies, SDKs, pixels, and comparable tools to keep you signed in, remember preferences, measure site performance, and deliver tailored ads. You may disable cookies in your browser, though some features may not work properly. 

7  Third‑Party Integrations & Social Features 

Interactive features such as live chat or “share” buttons may allow third‑party platforms to collect information about your interaction with the Services. Your use of these features is governed by the privacy policies of the respective platforms. 

8  Your Privacy Choices 

  • Access or update key profile details in your account dashboard. 
  • Request deletion of your account and associated personal information. 
  • Opt out of marketing emails via the “unsubscribe” link or account settings. 
  • Control ad tracking through industry tools (e.g., NAI, DAA) or browser settings. 
  • Residents of applicable U.S. states may exercise additional rights (access, delete, correct, opt‑out of “sales”/“sharing”); email privacy@optelux.com. 

9  Security 

We implement reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is perfectly secure; please use strong passwords and keep them confidential. 

10  Children 

Our Services are intended for individuals aged 13 or older. We do not knowingly collect personal information from children under 13. Parents who believe we have improperly collected such data should contact us for deletion. 

11  Additional U.S. State Privacy Disclosures 

If you reside in a U.S. state with comprehensive privacy legislation (e.g., California, Colorado, Virginia), you may have rights to access, delete, correct, or opt out of certain data practices, including “sales” or cross‑context behavioural advertising. To exercise these rights, email privacy@optelux.com. We must verify your identity and may deny requests under statutory exceptions.
